Surrendered on March 12, 2007 on a complaint, filed under seal on February 28, 2007, charging him with one count of conspiracy (18 U.S.C. ยง 371) stemming from a massive, Costa Rica-based telemarketing fraud scheme that targeted thousands of U.S. residents, resulting in victim losses of more than $10 million. The complaint was unsealed on March 12 when the defendant surrendered.

Hofhenke pled guilty on June 5, 2007 and was sentenced on October 28, 2008 to 87 months' incarceration and ordered to pay 5 million in restitution, jointly and severally with his co-defendants.
