Complaint Process

All Complaints are Confidential
          



         1. OBNE office receives and records complaint.
        
         2. The complaint is taken to the Board for review.
 
          
 
          No violation of statute or rule found:
          3. A letter of closure is sent to the complainant.

          4. The file is closed.
 
         
 
          Possible violation of statute or rule found:
          3. The board requests a response from the practitioner. The board may also review patient
              chart notes and files. 

          4. The board reviews the complaint with the practitioner’s response, and patient records.

          5. The board determines if there is enough substantiating information to continue the
              investigation and discipline.          

 
         
 
          Complaint is found to be unsubstantiated:
          6. If the complaint is found to be unsubstantiated, a letter of closure is sent to the  
              complainant and the practitioner.

          7. The file is closed.

 
         

          Complaint is substantiated:

          6. Further investigation may be done to determine the severity of the violations.

          7. Based on the results of the investigation, the board will take disciplinary action.

          8. Notice is issued to practitioner.

 
         
 
          The practitioner agrees with Notice:
          9. A Final Order is issued.

 
         

          The practitioner contests the Notice:

          9. Central Hearings Panel conducts a hearing.

          10. A Proposed Order is issued from Central Hearings Panel.

          11. The board reviews that order.

          12. A Final Order is issued.

          13. Practitioner can take the case to Court of Appeals for Due Process.
