Summary of Law(s) and Regulation(s):
Benefits denied for violating employer’s drug-free workplace policy; burden of proof for cause in on the employer, and the presumption of eligibility is with the employee; employer may introduce a drug and/or alcohol test to demonstrate violation of policy, which will create a rebuttable presumption of violation, which can be disputed by employee by submitting laboratory test results.
