Summary of Law(s) and Regulation(s):

Alcohol and Drug Rehabilitation—Employers of 25 or more must reasonably accommodate employee wishes to participate in a rehabilitation program, provided no undue hardship is created. Cal. Lab. Code §1025 et seq. (1989)

Payment for Medical Examination—Employee may not have to pay for pre-employment or continuing employment exam. Cal. Lab. Code §222.5 (1989 and Supp. 2006)

On-Site Testing--The California Department of Health interprets the state's laboratory licensing law to prohibit any drug test not performed in a certified laboratory or by a licensed physician. Cal. Bus. & Prof. Code § 1206 (West. 2003)
