Partnership Agreement
 
Overview: The Partnership between OSHA and the Kansas Contractors Association (KCA) encourages participants to develop and/or enhance their safety and health management systems. The Partnership also targets the four major construction hazards: falls, electrocutions, caught between/struck by, and trenching and excavation. The goal is to increase the number of construction companies that implement effective safety and health management systems as well as develop criteria for a model contractor safety and health management system.

Results: This Partnership has facilitated dialog between OSHA, the Kansas Contractors Association, and its member contractors. As a result, OSHA now has an avenue to perform outreach and education on subjects such as record keeping and highway work zone safety.

Training sessions were conducted in 2005 which affected 503 employees and 139 supervisors/managers. The training sessions covered confined space, excavation, aerial lift, fall protection, and scaffold training in addition to OSHA 500 and 510 courses.

In 2005, a total of 2980 self-inspections were performed, uncovering 2050 hazards/violations that were corrected/abated.

The Partnership participants' total case rate was reduced from 6.42 in 2001, the first year of the Partnership, to 4.5 in 2004 which is below the baseline rate of 5.21. Also, the days away rate reduced from 4.36 in 2002 to 1.23 in 2004. The total case and days away three-year rates are both below the BLS National Averages for 2004.

Overview: Recognizing that the masonry industry is one of the largest users of scaffolding, this Partnership has a strong focus on fall hazards, as well as electrical hazards, caught-between and struck by injuries, and trenching and excavation operations. Participants are recognized for their safety and health accomplishments, and work together with the union and Association to reduce illnesses and injuries by 10% during this three-year agreement. This Partnership will develop an outreach program where the criteria for a ‘model’ company is developed, and qualifying companies will mentor smaller contractors or those needing assistance with their safety and health management systems.

Results: During the final year of the initial 3-year agreement period, which ended on July 15, 2006, the Partnership impacted 8 employers and 400 active employees. For the full 3-year period, the total case rate was 7.1, down slightly from the baseline established for this partnership. Significantly, the DART rate (days away, restricted, job transfer) was down 14.8%, exceeding the 10% reduction that was a Partnership goal. In recognition of the benefits achieved during the Partnership, the partners undertook renewal talks and signed a 3-year renewal agreement on March 1, 2007.

Overview: The purpose of this Partnership is to develop a St. Louis construction industry/labor/government collaboration that will encourage contractors in the city to improve their safety and health performance, assist them in their efforts, and recognize contractors with exemplary safety and health management systems. Five organizations around the St. Louis area have signed up for this effort. Ultimately, the Partnership will focus on the four most common hazards in the construction industry: falls, electrocutions, caught-between and struck-by injuries, and crushed-by-trenching and excavation operations.

Results: In 2005, the partnership impacted 9 employers and 1488 employees. 51 training sessions were provided to 419 employees and 46 supervisors, totaling almost 3,000 hours. The partnership achieved a TCIR rate of 1.8, well below the BLS National Average of 6.4. A DART rate of 1.1 was achieved, well below the BLS National Average rate of 3.4. Both TCIR and DART rates reduced almost 50% since the inception of the partnership. In recognition of the benefits achieved during the Partnership, the partners decided to renew the partnership and signed a 3 year renewal agreement October 5, 2006.

The Partnership will focus on injuries, illnesses and fatalities from the four major causes; falls, struck-by, caught-in/between, and electrocutions.

Results: This partnership, impacting 34 employers, provided 13 training sessions for 435 employees.

Overview: The Build Safe Partnership Program (BSPP), after a successful 3-year renewal term, was renewed again for an additional 5 years in a ceremony held April 26, 2007. Signatories are The Builders’ Association and OSHA’s Kansas City Regional Office (Region VII), Kansas City Area Office, St. Louis Area Office Wichita Area Office, and Omaha Area Office. The Builders’ Association, which is a chapter of the Associated General Contractors (AGC), represents union and non-union companies throughout Missouri and eastern Kansas, including some who operate in Nebraska.

The partnership, with 21 active participants at time of its second renewal, encourages contractors to voluntarily improve their safety and health performance by implementing effective safety and health management systems and effective safety and health training programs for management, supervisors, and employees. The goal of fatality, injury and illness reduction focuses on falls, struck-by, caught-in/between, and electrocutions at construction sites; and amputations, cuts, lacerations or punctures, lockout/tagout hazards, and machine guarding at the participants’ fabrication shops.

Results: The Days Away (DART) rate decreased 15.3% and the Total Recordable Injury Case Rate (TCIR) decreased 26.4% for the period 2003-2005 for the group of 22 contractors. In addition, the 2005 TCIR for the group was 32.5% below the BLS average rate for the construction industry. For calendar year 2005, there were no fatalities and only 52 lost-time accidents out of 12,539,883 manhours worked.

Overview: This partnership seeks to reduce injuries, illnesses and fatalities resulting from the following hazards:

Sheet metal workplaces: amputations, cuts, lacerations or punctures, lockout/tag-out and machine guarding hazards.

Construction workplaces: falls, struck-by, caught in/between and electrocutions.

The goal is to prevent fatal accidents and achieve a Days Away Case Rate (DACR) below the national average as reported by the Bureau of Labor Statistics.

This partnership will implement an aggressive fall protection program, require frequent jobsite inspections, and ensure that employees receive adequate safety and health training at both construction job sites and in sheet metal shops.

This partnership covers the Kansas City and Wichita Area Offices.

Results: In 2005, the partnership achieved TCIR rate of 6.45, well below the BLS average of 8.1. In addition, 209 employees were trained.

Overview: The goal of this residential construction partnership between the Home Builders Association of Greater St. Louis and the St. Louis and Kansas City, MO Area Offices is to reduce the number and severity of injuries, illnesses and fatalities affecting participating contractors resulting from falls, struck-by, caught-in/between and electrocution hazards. It is also anticipated that there will be an increase in the number of participating members/employers who implement effective safety and health programs.

A key goal will be to help business develop safety and health programs that involve employers and workers in identifying and controlling hazards before they result in injuries. Under the terms of the partnership, contractors will put safety and health programs into action that require fall protection when employees perform work that is more than six feet above the lower level. The safety programs will enable workers and supervisors to recognize and abate safety and health hazards before work begins. Contractors must conduct regular job site inspections and train all workers on typical residential construction hazards.

Overview: This partnership is committed to promoting a high safety standard during construction of the new Chaifetz Arena, St. Louis University’s new $80.5 million arena. The University, the St. Louis Building and Construction Trades Council, and the Carpenters’ District Council of Greater St. Louis and Vicinity have pledged their support for the agreement.

Clayco, with 250 employees and project subcontractors on site, has agreed to a goal of zero fatalities and a lost time incidence rate below the BLS national average. The incidence rate for this partnership is established as 3.4. The agreement includes safety and health training for all project personnel and implementation of an aggressive 6-foot fall protection plan. The project will provide the forum for a pilot Safety Mentoring Program initiative by Clayco, to assist minority and disadvantaged businesses in the development and implementation of quality safety programs and the promotion of a positive safety culture within their organizations. Clayco also has agreed to apply for approval to OSHA’s Voluntary Protection Programs.

The new arena, a 269,531-square-foot structure located in the city’s midtown area, will serve as a multi-purpose facility for SLU sports, including basketball and volleyball. It also will host a variety of other events, including concerts, shows and commencements. It features 10,600 arena seats with 12 private suites, a two-court basketball/volleyball practice facility, and support facilities for the athletic department and all SLU Division I sports programs. Chaifetz Arena is scheduled for completion in spring 2008.

Overview: In recognition of the importance of providing a safe and healthful work environment for employees in long-term care facilities and the need to implement a comprehensive program for safety and health for the long-term care community and the value of employers, employees, safety/risk management, mentors, professional associations and the government in bringing their respective skills to bear in a cooperative, focused, and voluntary effort to promote worker safety and health, the St. Louis Area Office and Kansas City Area Office of the Occupational Safety and Health Administration, U.S. Department of Labor, the Missouri On-Site Safety and Health Consultation Service, and Health Systems, Inc., agree to the joint implementation of this OSHA Partnership Agreement.

Bureau of Labor Statistics (BLS) data revealed that “Nursing and Residential Care Facilities” had a total recordability injury and illness rate (TCIIR) of 9.1 and a Days Away, Restricted, and Transfer (DART) rate of 5.7 for 2005. The TCIIR is nearly twice the national average for all private-sector employers (4.6 in 2005), and over twice the nationwide DART rate (2.4). The partners and stakeholders agree that injuries caused by resident transfers and workplace violence related to resident aggression are two of the primary causes of injuries responsible for high injury and illness rates in their workplaces. Long-term care facilities also find that they have difficulty attracting and retaining employees. Although there are many factors that may contribute to this situation, it is thought that improving the overall safety and health working conditions, with adequate employee participation, may also improve the high turnover rate associated with nursing homes.

The goal of this partnership is to reduce total case injury and illness rates (TCIIR) and Days Away, Restricted, and Transferred (DART) rate by 10% at the end of the 3-year period.

Overview: Recognizing the importance of providing a safe and healthful work environment for employees in ethanol manufacturing facilities and the need to implement a comprehensive program for safety and health for the ethanol manufacturing industry and the value of employers, employees, the government, and advocacy groups in bringing their respective skills to bear in a cooperative, focused, and voluntary effort to promote worker safety and health, the Omaha Area Office, the Nebraska Workforce Development - OSHA Consultation Program, the Nebraska Ethanol Board, and the Midwest Ethanol Coalition agree to the joint implementation of this OSHA Partnership Agreement on behalf of ethanol manufacturers throughout the State of Nebraska.

The primary goal of this partnership is to ensure that each participant minimizes the potential for catastrophic incidents involving the production, storage, or transportation of ethanol, by following recognized and generally accepted good engineering practices with regard to their chemical process safety program. In addition, a secondary goal of this agreement is to ensure that each participant has developed an adequate emergency response plan, for operations involving releases of, or substantial threat of releases of, hazardous substances such as ethanol. The partnership also aims to reduce Total Case Incident Rates (TCIR) and Days Away, Restricted, and Transferred (DART) rates of the participating facilities by 10%, at the end of the 2-year implementation period.

Overview: The St. Louis Area Office of the Occupational Safety and Health Administration, S.M. Wilson & Co., project subcontractors, and labor organizations recognize the need for a safe and healthy jobsite. The goal of this partnership agreement is to help ensure that the new Bio-Medical Research Building #1 will provide a safe work environment for all employees.

This Partnership is designed to not only address the hazards within the construction industry, but
also to promote and recognize those jobsites that have a demonstrated and effective safety and
health program.

Goals of this partnership agreement include:
 
  1. Maintaining a lost time incidence rate below the BLS national average without fatalities;
  2. Conducting jobsite inspections utilizing a system developed by the Partnership Members;
  3. Ensuring employees receive safety training;
  4. Implementing a Fall Protection Plan to include fall protection in all cases where work is being performed six feet or more above a lower surface;
  5. Requiring all subcontractors who have written safety and health programs to submit them to S.M. Wilson & Co. before the start of any on-site work;
  6. Apply for participation in OSHA’s Voluntary Protection Programs when construction has been ongoing for one year; and
  7. In addition to the implementation of a broad-based safety and health program, the following special focus areas will be maintained throughout the duration of this project: working on or around Metrolink, FAA helicopter communication procedure, public protection/signage program, medical gas tank area, post-incident investigation process, pre-activity meetings for each subcontractor verifying recognition of hazards, safe work methods and utilization of training.

Overview: The St. Louis Area Office of the Occupational Safety and Health Administration, Ozark Constructors and project subcontractors recognize the need for a safe and healthy jobsite. The goal of this partnership agreement is to help ensure a safe work environment for all employees, subcontractors and visitors during the rebuild of the existing Taum Sauk Upper Reservoir Dam in Reynolds County, Missouri. This project will encompass the rebuild of the existing Taum Sauk Upper Reservoir Dam in Reynolds County, Missouri, approximately 120 miles south of St. Louis. The Upper Reservoir is impounded by a kidney-shaped concrete faced rockfill dike, and will be replaced with a conventional roller compacted concrete (RCC) dike.

Overview: The Kansas City Area Office of the Occupational Safety and Health Administration, Hunt-Walton, A Joint Venture, The Builders’ Association and project subcontractors recognize the need for a safe and healthy jobsite. The goal of this partnership agreement is to help ensure that the Kauffman Stadium Renovation Project will provide a safe work environment for all employees.

This project will encompass the renovation of the Kauffman Stadium ballpark for the Kansas City Royals. The Kauffman Stadium Renovation Project consists of approximately seven phases of construction: outfield construction, a new three story administration building in front of the stadium, a diamond club, broadcast booths, renovation of older suites, writing press and dining, expanded concourses and other internal renovations with a scheduled completion date of July 2009.

Overview: Pursuing efforts to maintain a lost time incidence rate below the Bureau of Labor Statistics (BLS) national average of 3.2 and a goal of zero fatalities, OSHA; Dondlinger and Sons Construction Company Inc.; Hunt Construction Group and Kansas Consultation Project, Kansas Department of Labor signed a safety and health partnership agreement on March 19, 2008.

The partnership will focus in particular on construction industry related hazards such as: falls; electrocution; struck-by; caught-in-between; trenching and excavation during the construction of the Sedgwick County Arena in Wichita, KA.

The goal for this partnership is to achieve a reduction of accidents, injuries and illnesses on the project. In addition, all employees will receive a site-specific safety orientation and training from the partners, who will address jobsite safety and health issues and procedures pertinent to the work being performed.

The Sedgwick County Arena consists of a 15,000 seat, 4 level, multi-purpose sports and entertainment Venue, which will be constructed from cast-in place concrete frame and steel longspan roof trusses. All foundation work for the building has been completed, except for foundations for the service yard area and exterior retaining walls. The foundation system consists of 1,222 piles (concrete columns) and 292 pile caps, structures which reach 60 to 65 feet into the ground.

The new facility is scheduled to open January, 2010.
