ORDER REGARDING RESPONDENT'S POST-HEARING BRIEF

   Respondent's timely, and simultaneously with Complaint, filed their Post-Hearing Brief in the above-captioned matter on December 23, 1997. On December 29, 1997, this Office was copied a letter from Attorney Burnett to Attorney Colapinto regarding reference to sensitive medical information in Complainant's Post-Hearing Brief. Complainant's counsel had designated that information as Confidential and filed under seal. Respondents' did not similarly redact those portions of its Post-Hearing Brief which referred to medical information. Respondents offered to modify their Brief to appear in a fashion similar to Complainant's brief.

   Complainant responded by letter dated January 5, 1998 and stated his understanding that the entire deposition of a treating physician was under seal. Respondents' response is contained in its January 5, 1998 letter. On January 6, 1998, Respondents filed a revised copy of their Post-Hearing Brief which redacted those portions which contained sensitive medical information.

   Accordingly, the Respondents' original unredacted Brief is hereby returned to Respondents by this Office. It is hereby ORDERED that the revised copy of Respondents' Post-Hearing Brief shall be considered its original filing and shall be the only version of Respondents' Post-Hearing Brief that is part of the record in this case.
