On January 31, 2002, Complainant filed a Motion for the Production of the EPA OIG Investigative Manual, with any supplements, covering the time period of 1994 to 1998 with all subsequent revisions. On February 1, 2002, Complainant filed the declaration fo EPA OIG Senior Agent Robert E. Tyndall. After considering the declaration of Mr. Tyndall, I find it appropriate to GRANT this motion because the manual is highly probative going to the heart of Complainant's case of harassment, of adverse working conditions, and hostile working environment. The importance of this document overrides counsel's failure to act in a timely fashion in filing a Motion to Compel. IT IS HEREBY ORDERED that Respondent OIG shall, on receipt of service of this Order, immediately turn over the Inspector General investigatory manual to Complainant's Counsel.
