Pagliarini, Jr. The Office of Personnel Management (OPM) recently issued a revised Interagency Delegated Examining Agreement to the Department detailing the competitive examining authority delegation to agencies under the provisions of 5 U.S.C. 1104, as amended by Public Law 104-52 of 1995. The Agreement identifies the responsibilities of OPM and agencies in carrying out the competitive examining process and establishes the conditions to be honored by each party. The basic agreement was developed in 1995 and updated in 2000. OPM has since recognized the need for greater flexibility and options in carrying out delegated examining activities, resulting in the current revision. As the Department fully intends to continue exercising this authority, the Agreement has been signed and is attached for your files. Please keep in mind that OPM delegates examining authority at the headquarters level and allows the Department to decide which components will carry out the associated functions. Therefore, it is imperative that you ensure that your use of this authority complies with the law and merit systems principles at all times, as the Department is ultimately held accountable for the actions that result.
