Antittrust Criminal Sentences Imposed

U.S. v. Atlas Iron Processors, Inc., et. al (S.D. Fla.), filed 11/13/97

Two corporations and four individuals charged with conspiring to fix the prices and allocate suppliers of scrap metal in the Miami Florida area. Trial began January 25, 1999, and all defendants were found guilty on the one-count indictment. On July 30, 1999 the following sentences were imposed:

Atlas Iron Processors, Inc. - ordered to pay a fine of $356,175, plus disgorgement of $34,136, which pursuant to USSG § 8C2.9 is added to the fine for a total of $390,311, restitution in the amount of $42,931, five years probation and $100 special assessment.

Sunshine Metal Processing, Inc. - ordered to pay a fine of $469,865, plus disgorgement of $25,945, which pursuant to USSG § 8C2.9 is added to the fine for a total of $495,810, restitution in the amount of $74,009.42, two years probation and $100 special assessment.

Anthony J. Giordano, Sr., Anthony J. Giordano, Jr., David Giordano - each received the same sentence of one year jail, a fine of $31,800, one year supervised release and a special assessment of $50.00.

Randolph J. Weil - was sentenced to one year jail, a fine of $41,950, one year supervised release and a special assessment of $50.00.
