Independent (Private) adoptions fact sheet

Adoption Category Child Placement- By Whom Petitioner's Relationship to Child (Adoptee) Home Study & Other Requirements
Step-parent Married couple Spouse's child(ren) Home study (HS) may be waived; criminal background check is required for all adults in the home, except birth/legal parent(s), all household members over the age of 18 must submit to a criminal background check; bio parents must consent to the adoption — whether retaining or relinquishing parental rights. Grandparents notice, if applicable. Medical/Genetic history (CF 246) not required.

Agency (domestic or international adoption) Licensed adoption agency in Oregon or in another state (illegal when “facilitators” are involved) Not related; relative beyond the first degree blood relationship; and/or legal guardian HS (valid for 2 yrs.); out of state home study must be approved by an Oregon contracted agency; medical/genetic history (CF 246 and CF 246A)(PDF); agency consents to the adoption. Interstate Compact (ICPC) requirements may apply; contact ICPC, 503-945-7019 for information.

Relative First degree blood relation only Maternal or paternal grandparents, aunt & uncle, brother/sister HS may be waived if child has lived continuously with petitioners for 6 months from birth, or one year if child is older than 6 months; birth parents consent to the adoption; petitioners submit to a criminal background and child abuse checks; Medical/Genetic history (CF 246 and CF 246A).

Advisable in order to obtain an Oregon birth certificate. For additional information, refer to Child Citizenship Act of 2000.

(Independent Adoption)
No private agency is involved, except for completing the home study. Birth parent(s) directly places the child for adoption with a family of their choice; usually with legal assistance from an attorney (illegal when “facilitators” are involved) None; related beyond the first degree blood relationship. HS (no more than 2 years old) from an OR contracted agency; if from out of state, HS must be approved by an OR contracted agency (refer to list); current medical/ genetic history (CF 246(PDF) and CF 246A); post-placement report fee ($675) paid to DHS at the time of filing; birth parents consent to the adoption.
