Mission Statement
The mission of the Employment Relations Board is to resolve disputes concerning labor relations for an estimated 3,000 different employers and 250,000 employees in public and private employment in the State. The three Board members are supported by a staff of nine employees. The Board administers the laws governing employment relations and public employers and employees in the state, counties, cities, school districts, transportation districts, and other local governments of private employers and employees not subject to NLRB jurisdiction.
 
The Board has three primary functions:
  1. Determine appropriate bargaining units and conduct elections regarding collective bargaining representation for employees;
  2. Resolve disputes over union representation and collective bargaining negotiations, including providing mediation and conciliation services; and
  3. Issue declaratory rulings and orders in contested case adjudications of unfair labor practice complaints, appeals from state personnel actions, and related matters.

The quasi-judicial three-member full-time Board appointed by the Governor operates under the provisions of ORS 240, ORS 243.650 through 243.766, ORS 662.405 through ORS 662.555 and ORS 663.005 through ORS 663.325. OAR Chapter 115 contains the Board's administrative rules.

Annual Performance Measures

The Employment Relations Board was established in 1977. The board determines appropriate bargaining units for state and local governments and private companies not involved in interstate commerce; conducts elections to determine which labor organization, if any, the employees want to represent them in collective bargaining; resolves unfair labor practice complaints and determines whether strikes are lawful; and reviews personnel actions alleged to be arbitrary, contrary to law or rule, or taken for political reasons that affect unrepresented, classified state employees.
 
The Board's Conciliation Service Division provides mediation services for resolving collective bargaining disputes in public and private employment and provides lists of fact-finders and arbitrators for the resolution of labor disputes.
 
The Board consists of three members appointed by the governor for four-year terms.
