On January 24, 2008, a Notice of Violation and Proposed Imposition
of Civil Penalty in the amount of $650,000 was issued to Entergy
Nuclear Operations, Inc. This action was based on a continuing SL
III violation of the NRC’s January 31, 2006, Confirmatory Order
to implement Section 651(b) of the Energy Policy Act (Act) of 2005.
The Order required Entergy to install backup power for the Indian
Point Alert and Notification System (ANS) by January 31, 2007. The
NRC subsequently extended, at the licensee’s request, the implementation
date to April 15, 2007. On April 23, 2007, the staff issued a Notice
of Violation and Proposed Imposition of Civil Penalty in the amount
of $130,000 when Entergy failed to meet the April 15, 2007, implementation
date. On July 30, 2007, the NRC issued an Order to supplement the
requirements of the January 31, 2006, Confirmatory Order, based on
Entergy's proposed corrective actions for noncompliance with the
Confirmatory Order. On August 30, 2007, the staff issued a subsequent
Notice of Violation for Entergy’s failure to place the new
ANS in service by August 24, 2007, as required by the July 30, 2007,
Order. As of April 16, 2007, the licensee remains in violation of
the Orders. |

On August 30, 2007, a Notice of Violation was issued for failure
to meet the conditions of a July 30, 2007, Order which required the
licensee to implement an Emergency Notification System (ENS) with
backup power capability by August 24, 2007. Specifically, the licensee
failed to obtain necessary approvals so that the new ENS system could
be placed in service as the primary notification system by August
24, 2007. The NRC will determine the severity level, any civil penalty,
and any required responses from Entergy regarding this matter at
a later time. |

On July 30, 2007, an Immediately Effective Order was issued to
Entergy Nuclear Operations, Inc., to ensure compliance with the regulations
and implementation of the requirements of the Energy Policy Act of
2005. The Order supplemented the requirements of NRC Confirmatory
Order (EA-05-190) which required, in part, a backup power system
for the Emergency Notification System (ENS). The Confirmatory Order
was issued to the Indian Point Nuclear Generating Unit Nos. 2 and
3 on January 31, 2006, and was amended by the NRC on January 23,
2007, extending the implementation date for the required ENS backup
power system to April 15, 2007. The requirements of the January 31,
2006, Confirmatory Order remain in effect except as specifically
modified or supplemented by this Order. |

On April 23, 2007, a Severity Level III Notice of Violation and
Proposed Imposition of Civil Penalty in the amount of $130,000 was
issued to Entergy Nuclear Operations, Inc. for failure to meet the
requirements of a Confirmatory Order (EA-05-190) issued on January
31, 2006. The Order required that the licensee provide and maintain
a backup power supply for the Indian Point Emergency Notification
System (ENS). Specifically, the "radio only activation" feature,
the portion of the ENS for which the backup power capability was
provided, was required to meet its test acceptance criteria by April
15, 2007. The licensee did not meet its test acceptance criteria,
resulting in the ENS not being fully operable by April 15, 2007. |

On January 31, 2006, an immediately effective Confirmatory Order
Modifying License was issued to Entergy Nuclear Operations, Inc.,
Indian Point Units 2 & 3. The licensee consented to modifying
its operating licenses for Indian Point Units 2 and 3 to meet the
criteria in Section 651(b) of the Energy Policy Act of 2005, that
directs the Commission to require that backup power is to be available
for the emergency notification system of a power plant, including
the emergency siren warning system, if the alternating current within
the 10-mile emergency planning zone of the power plant is lost. |

On August 1, 2005, a Notice of Violation was issued for a violation
associated with a White SDP finding involving leakage of water from
a safety injection accumulator which contained absorbed nitrogen
gas. The licensee's evaluation and correction of this condition adverse
to quality was inadequate. The violation cited the licensee's failure
to (1) recognize the potential for nitrogen gas intrusion into
the safety injection system and the resultant potential challenge
to safety injection pump operation; and (2) adequately assess industry
operating experience related to safety injection accumulator back
leakage. |

involving a white SDP finding involving a moderate degradation of
the control room west wall fire barrier. The violation cited the Entergy's
failure from the time of initial construction in 1978 to August 2002,
to implement and maintain in effect all provisions of the NRC-approved
fire protection program. |

On November 20, 2000, a Notice of Violation was issued for a violation
associated with a Red SDP finding. The violation involved the licensee's
failure to identify and correct a significant condition adverse to
quality involving the presence of primary water stress corrosion cracking
flaws in the steam generator tubes, despite opportunities during the
1997 refueling outage. As a result, one of the tubes failed on February
15, 2000, when the reactor was at 100% power. |

violations that were assessed as White SDP findings. These White
findings involved failures to met NRC emergency planning standards
for (1) the timely augmentation by the emergency response organization,
(2) the timely accountability of onsite radiation emergency workers,
and (3) the factual and consistent dissemination of information
to the media and a local official. These failures contributed to
emergency response deficiencies that were exhibited during the course
of the SGTF Alert event.

involving: (1) failure to translate design basis requirements into
procedure of the 480 Volt (V) vital bus degraded voltage relays, which
led to loss of offsite power to the vital busses; (2) failure to ensure
that procedures used to calibrate the breaker trip units for the emergency
diesel generators (EDGs) were adequate, which led to the inoperability
of one EDG, and (3) failure to take corrective actions for a significant
condition adverse to quality involving repetitive problems with the
reactor protection system over-temperature/delta temperature circuitry,
