Abstract: | Proposes amendments to the procedural rules governing simplified adjudicative proceedings before the Occupational Safety and Health Review Commission and its Administrative Law Judges. Subpart M is changed to encourage greater use of simplified proceedings and to give the Commission the final word on whether to use simplified proceedings or conventional proceedings when the parties cannot agree. 2200.202 lists the standards that are not eligible for simplified proceedings. A request for simplified proceedings shall be filed within ten days after the notice of docket is received. Comments must be received by March 20, 1987. |
