The United States Court of Appeals for the Fourth Circuit remanded this case for consideration of complainant's "separate claim of discrimination by retaliatory harassment." English v. Whitfield, No. 87-3520, slip op. at 18 (Oct. 6, 1988). The Court of Appeals upheld the Secretary's decision that Complainant's other, independent claim of retaliatory discharge was time barred. Id. at 12-13. Accordingly, this matter is REMANDED to the Administrative Law Judge for further proceedings consistent with the order of the Court of Appeals. SO ORDERED.
