Definitions and clarifications

2. Paragraph (d) - General Requirements
a. Personal Protective Equipment. The final rule requires that
the employer provide, at no cost to the employee, appropriate eye, face, head, hand and
leg protection. The employer is not required to provide logging boots for employees. The
cost of logging boots may be borne by employees. The employer must assure, however, that
logging boots, as well as all PPE provided by the employer, are worn by employees and are
in serviceable condition and meet the requirements of paragraph (d).
b. Protective material may be damaged or destroyed in the course of work (e.g., while
stopping a chain saw). When only the outer covers of the protective equipment have been
penetrated, it does not necessarily mean that the equipment is no longer serviceable.
However, where there are also cuts or tears in the protective material of the logging boot
or leg protection, such equipment is no longer in serviceable condition. Such cuts and
tears in the protective material compromise the ability of the PPE to provide the level of
protection which is necessary. In situations where footwear and leg protection cannot be
repaired it must be replaced with PPE which is serviceable.
