Executive Order 13201

Executive Order 13201 (E.O. 13201) requires certain government contracts and subcontracts to include an employee notice clause requiring non-exempt federal contractors and subcontractors to post notices (Beck poster) informing their employees that they have certain rights related to union membership and use of union dues under federal law. The employee notice clause does not have to be included in government contracts for purchases below the Simplified Acquisition Threshold (currently $100,000).

The Employment Standards Administration’s Office of Labor-Management Standards (OLMS)  and Office of Federal Contract Compliance (OFCCP) jointly administer E.O. 13201.

Poster Requirements

The notice clause included by federal agencies in contracts requires contractors and subcontractors to post Executive Order 13201: Notice of Employee Rights Concerning Payment of Union Dues (Beck) Poster which may be downloaded and printed from the Web.  The poster is also available in Spanish. Note that for those contractors subject to the Railway Labor Act, there is a separate poster, the Notice of Employee Rights Concerning Payment of Union Dues for Contractors Subject to the Railway Labor Act Poster (PDF).

The poster must be 11 by 17 inches or larger.

Certain contractors or work sites are exempt from the Executive Order and thus do not have to post the Beck Poster. The posting requirement does not apply to:

  • Contractors with fewer than 15 employees.
  • Contractor establishments or construction work sites where no union has been formally recognized by the prime contractor or certified as the exclusive bargaining representative of the prime contractor's employees.
  • Contractor establishments where state law forbids enforcement of union-security clauses ("right-to-work" states).
  • Work performed outside the United States that does not involve the recruitment or employment of workers within the United States.

All other federal contractors and subcontractors are required to post the notice at all establishments unless the contractor makes a written request to OLMS and is granted a waiver of the posting requirement for facilities that are in all respects separate and distinct from activities of the contractor related to the performance of a contract.
