ENERGY'S FISSILE MATERIALS DISPOSITION PROGRAM |
The Commission approved the staff's recommendation that NRC function as a "commenting agency" in the context of
reviewing the Department of Energy's plutonium disposition site-specific Environmental Impact Statement, rather than
participating as a "cooperating agency." The staff should inform the Department of the Commission's position on this issue.

In addition, since the terms of the modified reimbursable agreement under which NRC assistance is being provided to the
Department's Fissile Materials Disposition Program enables the NRC to continue to recover its full costs for technical
support, the staff should consider any support provided under the Agreement as "business like" and identify it to be
separate from and in addition to the FTEs the agency will request to carry out its activities.
