SUBJECT: STAFF REQUIREMENTS - SECY-00-0009 - RULEMAKING PLAN, REACTOR FIRE PROTECTION RISK-INFORMED, PERFORMANCE-BASED RULEMAKING

This is to advise you that the Commission has not objected to the proposed rulemaking plan to revise 10 CFR 50.48, as described in SECY-00-0009, subject to the following comments.

The staff should continue to work closely with the National Fire Protection Association (NFPA) and other stakeholders so the development of the consensus standard continues on an expedited basis and so the proper risk-informed, performance-based approach is maintained. Because the development of the rulemaking is closely tied to the NFPA 805 review and approval schedule, the staff should update the Commission on the status of NFPA activities, providing an assessment of progress, in December 2000, or sooner, if the NFPA milestones or the rulemaking schedule are significantly delayed.

The staff should keep interested stakeholders informed regarding the status of efforts to develop the NFPA standard.

The staff should discuss in the statement of consideration how selective implementation of the NFPA standard will be handled in the proposed rule.
