The Commission has approved publication of the proposed rule and issuance of the draft regulatory guide for public comment subject to the changes noted in the attachment. In addition, the Commission certifies that this rule, if promulgated, will not have a negative economic impact on a substantial number of small entities.

The staff should put in place an effective process to track receipt of notices from trustees indicating either an intention to amend a trust agreement or to make disbursements or payments from the trusts.

Changes to the Proposed Rule and Draft Regulatory Guide in SECY-01-0049

Changes to the Federal Register Notice

1. On page 5, revise the next to last line to read ' ... jurisdiction over electricity rates of the kind that they now exercise over electricity rates.'
   
   
2. On page 6, last paragraph, delete the word 'staff' from lines 2, 3, and 5.
   
   
3. On page 7, line 3 from the top, delete the word 'staff'.
   
   
4. On page 7, 1^st full paragraph, revise line 1 to read ' ... section of the notice paper presents a set ....'
   
   
5. On page 17, line 4 from the top, delete the word 'staff'.
   
   
6. On page 24, paragraph (i), revise lines 10 and 11 to read ' ... whose operations relating to in which the prepayment deposit is managed are regulated and ....'
   
   
7. On page 25, revise lines 2 and 3 from the top to read ' ... ... whose operations relating to in which the external sinking fund is managed are regulated and ....'

Changes to the Draft Regulatory Guide

1. On page 6, revise line 2 from the top to read ' ... formulas provided in 10 CFR 50.75(c)(1) and ....'
   
   
2. On page 10, paragraph 1.4.3, in line 2 change '1.5.1' to '1.4.1' and in line 4 change '1.5.2' to '1.4.2'
