Americans with Disabilities Act (ADA)

The Americans with Disabilities Act, (ADA) of 1990, P.L. 101-336, provides in part that “No qualified individual with a disability shall, by reason of such disability, be excluded from participation in, denied the benefits of, or be subjected to discrimination by a department, agency, special purpose district, or other instrumentality of a State or local government.” 

The following is the text of Titles I and V of the Americans with Disabilities Act of 1990 (Pub. L. 101-336) (ADA), as amended, as these titles appear in volume 42 of the United States Code, beginning at section 12101.  Title I of the ADA, which became effective for employers with 25 or more employees on July 26, 1992, prohibits employment discrimination against qualified individuals with disabilities.  Title I applies to employers with 15 or more employees beginning on July 26, 1994.  Title V contains miscellaneous provisions which apply to EEOC's enforcement of Title I.

The HDOT Office of Civil Rights (OCR), ADA Specialist, with the assistance from Divisional and Staff Offices, shall ensure that HDOT provides civil rights protection to individuals with disabilities in the areas of employment, public accommodations, services, and telecommunications.
