On December 7, 2006, a Notice of Violation containing six violations
categorized collectively as a Severity Level III problem was issued
as a result of investigations that determined that Hunt Valve engaged
in deliberate misconduct with respect to applicable quality assurance
(QA) requirements and deliberately failed to provide notifications
required by 10 CFR 21.21, "Notification of the Failure to
Comply or Existence of a Defect and its Evaluation," with
regard to the manufacture and distribution of uranium hexafluoride
(UF6) cylinder valves and components procured by U.S. Enrichment
Corporation (USEC). The NRC Office of Investigation substantiated
that Hunt Valve deliberately violated 10 CFR 21.21 and applicable
QA requirements, i.e., Hunt Valve ultimately delivered UF6 cylinder
valves that were not properly QA tested to a USEC facility (Paducah)
and caused USEC to violate its NRC certificate and to violate 10
CFR 76.93, "Quality Assurance." A civil penalty is not
being proposed in this case because the Department of Justice (DOJ)
settled a civil suit against Hunt Valve by negotiating a sizeable
monetary penalty of over $600,000 which significantly exceeds the
civil penalty the NRC would consider for this case. Further enforcement
action is not being taken against Hunt Valve’s former Quality
Manager and Hunt Valve’s former Vice President and General
Manager, Military Division, who deliberately committed the violations,
based on the results of their criminal prosecutions and subsequent
convictions. |
