In 1993, Congress amended 18 U.S.C. § 603 which governs political contributions by Federal employees to their
employer or employing authority. The original statute had been interpreted as potentially prohibiting all executive branch
employees from making political contributions to the reelection campaign committee of an incumbent President. However, by
memorandum dated May 2, 1995, the White House issued an opinion which states that based on
the Hatch Act Reform Amendments of 1993, 18 U.S.C. § 603 would no longer prohibit employees from making contributions
to the reelection campaign of an incumbent President.
