The Authority concluded that the Union failed to establish extraordinary circumstances and denied the Union's motion for reconsideration of the decision in National Treasury Employees Union and United States Dep't of the Treasury, Internal Revenue Service, 61 FLRA 618 (2006).
Section 2429.17 of the Authority's Regulations permits a party who can establish extraordinary circumstances to request reconsideration of an Authority decision. The Authority found that it did not raise an issue sua sponte that the Union should be permitted to address, and it did not err in finding that the Union had not established that a selection requirement violated Equal Employment Opportunity Commission's Uniform Guidelines.
