Suite 101, Roslyn Heights, NY 11577 Complainant's Name: Richard L. Barker Complainant's Address: 943 South Dean Circle, Deltona, Florida 32738-6801 Customer's Name: Richard L. Barker WHAT IS YOUR COMPLAINT?Name of mass media invention promoter advertised in: Radio WLIE-540 in NY, Internet (www.inventorshelpline.com) Invention promotion services offered to be performed: Assistance in getting a patent and in securing of license and mfg. agreements with manufacturers for 10% Explanation of complaint between customer and invention promoter: I have faxed you on November 16, 2004 about my dissatisfaction with your PTI report dated October 29, 2004 "Societal" "analysis item Number37". With your company staff technology information stating will this be regulated and the answer was "not likely". This is an untrue statement as OSHA or some Government Agency must regulate the product. At the time you informed me that you would contact me within ten days with your results pertaining to the problem. To this date I have not heard from you. I tried to contact you on several occasions and most recently on January 24, 2005 to resolve this money matter of $1,195 but received your voice mail and you have not returned my call. I have stated I will return the PTI and have been waiting for your instructions of the location to return it as it is of absolutely no value to me. In my letter of November 16, 2004, I stated the other legal issues of why I am not willing to pay for you to proceed further they are as follows: PTI report number 50 "Preliminary Patent
Search", I was informed that the fee I paid included a preliminary patentability
search and opinion, to inform me if it would be feasible to continue
any further with the invention, without this information the entire report
is useless.
But your firm only did a "Through Self" (in house) search. I informed that
a patent search was done in the past giving you the particulars and a
copy of the abstract, with the understanding you would do the search that
you informed
me you would conduct. The first date I contacted your company was August
25, 2004 and I was told by Mr. Please advise immediately the steps needed to be taken to correct this transaction, why I was contacted as you informed me you would obtain the information about OSHA. Therefore, you have not lived up to your obligation so you need to refund my money in the amount of One Thousand One Hundred and Ninety Five Dollars ($1,195) or I will need to contact my attorney.
