The above-captioned matter is presently set for hearing at the
U.S. Tax Court during the week of June 10, 1996 and Complainants
counsel, by pleading filed by facsimile transmission on May 28,
1996, has now moved to withdraw their request for hearing with
prejudice and no objection having been interposed thereto by
Respondents or by counsel for the Regional Solicitor, it is
determined that there now are no justiciable issues in controversy,
that the hearing shall be, and the same hereby is CANCELED,
that the COMPLAINANTS MOTION TO WITHDRAW REQUEST FOR
HEARING shall be, and the same hereby is GRANTED and
that this proceeding shall be, and the same hereby is DISMISSED
WITH PREJUDICE, pursuant to Rule 41(a)(2) of the Fed. Rules of
Civil Procedure. In this regard, seeWright & Miller
Federal Practice and Procedure: Civil 2d §2367 n.3.
