CASE NO. 92-TSC-9
IN THE MATTER OF
GROVER GLATFELTER,
COMPLAINANT,
v.
NEW ENGLAND MEDICAL CENTER HOSPITAL, INC.
RESPONDENT.
BEFORE: THE SECRETARY OF LABOR
ORDER APPROVING SETTLEMENT
The Administrative Law Judge (ALJ) submitted a Recommended
Order Approving Settlement and Dismissing Case in this case
arising under the employee protection provisions of the Toxic
Substances Control Act, 15 U.S.C. § 2622 (1988), and the
Energy Reorganization Act of 1974, as amended (ERA), 42 U.S.C.
§ 5851 (1988). The parties submitted a settlement agreement
to the ALJ on June 15, 1992, which among other things provides
for payment to Complainant of $30,000 in exchange for a general
release of all of Complainant's claims against Respondent, and
for dismissal of this case with prejudice. The parties submitted
an amended agreement on December 3, 1992.
The settlement agreement has been reviewed and I find that,
as amended, it is fair, adequate and reasonable and, I approve
it.
Accordingly, the complaint in this case is dismissed with
prejudice.
SO ORDERED.
