Pogue v. U.S. Dept. of the Navy, 88-TSC-3 (ALJ Oct. 27, 1993)

In the Matter of

BARBARA POGUE,

              Complainant,

             v.

UNITED STATES DEPARTMENT OF THE
NAVY, MARE ISLAND NAVAL
SHIPYARD,

              Respondent.

    CASE NO: 88-TSC-3

                          ORDER OF DISMISSAL
                      WITHOUT PREJUDICE

An Order of Stay was here issued 7/26/88. On 7/10/92 a Notice
to All Parties and to the Secretary of Labor was issued.

This matter has been long lingering before this Office and at
this point there is no basis to believe it should be maintained at
this Office. Without in any way affecting the status of this
matter, it appears its best handling administratively is to remand
the matter to the Administrator of the Wage & Hour Division,
Employment Standards Administration, U.S. Department of Labor,
without prejudice to any of the parties, for retention. 29 C.F.R.
Part 24.

     It is so ORDERED.
