   This matter arises under the Toxic Substances Control Act, 15 U.S.C. § 2622 and the implementing regulations at 29 CFR Part 24. The parties filed a signed Settlement Agreement on December 23, 2002.

   Review of the Settlement Agreement shows that it is in compliance with 29 CFR § 18.9 and that it fairly and adequately resolves all pending issues in this matter. Accordingly, it is hereby recommended that the Settlement Agreement, attached hereto and incorporated herein, be APPROVED and ADOPTED in it's entirety.
