   This proceeding arises under the employee protection provisions of the Surface Transportation Assistance Act of 1982 (STAA), 49 U.S.C. § 31105 (formerly 49 U.S.C. app. § 2305); 29 C.F.R. Part 718, which prohibits covered employers from discharging or otherwise discriminating against employees, who have engaged in certain protected activities. On January 25, 2002, a fully-executed Stipulation Without Prejudice was submitted to the Court. The parties stipulate to the dismissal of the proceeding and that there are no additional agreements in connection with the settlement in the above-captioned proceeding. Accordingly,

   IT IS ORDERED that the Stipulation of Dismissal Without Prejudice is APPROVED.
