   The above-captioned case arises under the Surface Transportation Assistance Act of 1982, (STAA) 49 U.S.C. § 31105.

   On June 18, 2001, the parties submitted for approval by the undersigned a Confidential Settlement Agreement and General Release, attached hereto and made a part hereof. Having duly considered the matter,

   IT IS ORDERED that the Confidential Settlement Agreement and General Release is hereby approved and the proceeding in this matter is DISMISSED, with prejudice.

   IT IS FURTHER ORDERED:

   1. That this Order shall have the same force and effect as an order made after a full hearing;

   2. That the entire record in which this Order is based shall consist solely of the Confidential Settlement Agreement and General Release

   3. The parties waive any further procedural steps before this Court;

   4. The rights and duties of the parties, in respect to this case, shall be defined in the Settlement Agreement,

   5. The settlement as defined in the settlement agreement is approved,

   6. The Complainant's complaint is hereby dismissed with prejudice. Each party shall pay its own costs except as provided in the settlement agreement.

   7 This Order and the decision of this Court shall be final agency action.
