USDOL/OALJ Reporter Reid v. Scientech, Inc., 1999-ERA-20 (ALJ Mar. 10, 2000)
Date: March 10, 2000 CASE NUMBER: 1999-ERA-00020 In the Matter of:
LEE REID,
v.
SCIENTECH, INC.,
A Recommended Decision and Order in the above-entitled matter was issued by the undersigned on January 28, 2000. On February 25, 2000, Dean Brandstetter, Counsel for Complainant (hereinafter referred to as "Counsel") submitted an application for approval of fees and costs, seeking $11,317.00 in fees for services performed by the law firm of Cox, Ohman & Brandstetter, $2,617.25 in fees for services performed by the law firm of Woolf, Combo & Thompson, and $3,816.27 in total costs incurred by Complainant, Cox Ohman & Brandstetter, and Woolf, Combo & Thompson. On March 9, 2000, Counsel for Scientech, Inc. (hereinafter referred to as "Respondent") filed a letter stating that it is not objecting to Counsel's fee petition. All such responses are incorporated herein by reference. The undersigned has reviewed the fee petition and concludes that the fee petition as submitted is reasonable and proper in view of the manner in which Complainant's counsel has successfully prosecuted this matter. Accordingly, Counsel's petition for fees and costs is hereby approved. It is my understanding that Complainant has advanced his attorney some fees and costs, the exact amount unknown. Therefore, Respondent's payment of fees and costs shall be payable jointly to Complainant, Lee Reid, and his attorney's law firm, Cox, Ohman & Brandstetter.
Respondent shall pay to Complainant, Lee Reid, and the law firm of Cox, Ohman & Brandstetter, the sum of $13,934.25 as and for fees and the sum of $3,816.27 as and for costs, for a total of $17,750.52.
