Recodification of the employee protection provision of the Surface Transportation Assistance Act

Editor's note: In the summer of 1994, Congress passed legislation "to restate in comprehensive form, without substantive change, certain general and permanent laws relating to transportation ... and to make other technical improvement in [Title 49 of the United States] Code." H.R. Rep. No. 180, 103d Cong., 2d Sess. 1 (1994), reprinted in 1994 U.S.C.C.A.N. 818.

Included in this recodification is the employee protection provision of the Surface Transportation Assistance Act. Formerly, this provision was codified at 49 U.S.C. app. § 2305. After recodification, the provision is codified at 49 U.S.C. § 31105.

According to the Section-By-Section Summary, the recodification resulted in the elimination or changing of several words and phrases considered surplus or unclear. See H.R. Rep. No. 180, 103d Cong., 2d Sess. 191-192 (1994), reprinted in 1994 U.S.C.C.A.N. 818, 1008-1009. The legislative history, however, makes it clear that the substantive law is intended to remain unchanged.
