   This matter under the solid Waste Disposal Act, 42 U.S.C. 6971, was referred to the Office of Administrative Law Judges pursuant to a request for hearing filed by the original Respondent, Buncombe County, N.C., Department of Community Improvement on November 30, 1984. A hearing was scheduled for December 19 and 20, 1984 before the undersigned. The parties reached a settlement prior to the hearing.

   The parties executed a settlement agreement on December 20, 1984 and filed a signed copy with the office of Administrative Law Judges on December 26, 1984. A copy of the settlement agreement, which effected a compromise and settlement of the issues in the above-captioned proceeding, is attached hereto.

   Pursuant to the settlement agreement the parties have stipulated that this case has been settled and may be dismissed with prejudice, each party to bear its own attorneys' fees and costs.

   Accordingly, it is ORDERED that the above-captioned case is DISMISSED WITH PREJUDICE.
