   Roger J. Backen and Entergy Operations, Inc. have submitted a Joint Motion to Approve Settlement Agreement and Order Dismissal, which reflects a settlement of all disputes involved in this litigation. Both parties seek approval of the settlement.

   Upon consideration of the Settlement Agreement reached between the parties and the Joint Motion to Approve Settlement, it is recommended that the Settlement Agreement between Roger J. Backen and Entergy Operations, Inc. be APPROVED, and it is further recommended that all proceedings against Entergy Operations, Inc. in this matter be dismissed. The terms of the settlement appear to be fair, adequate and reasonable and encompass all matters. Also, as acknowledged by the terms of the agreement, the confidentiality agreed to between the parties is not an attempt to prevent either party from communicating suspected violations of State or Federal laws.
