RECOMMENDED ORDER DISMISSING COMPLAINT

     By letter dated May 24, 1996, and by telephonic conference
with respondent's counsel on June 11, 1996, complainant states
that his discharge of July 13, 1995 has been rescinded through
the arbitration of Grievance No. 17173 by impartial arbitrator,
Donald S. McPherson.  Complainant therefore requests the
withdrawal without prejudice of his case.  Respondent agreed to
the dismissal without prejudice.

     For good cause shown, IT IS HEREBY ORDERED that the
complainant's request that his complaint be dismissed without
prejudice is GRANTED.
