On May 12, 1997, the successful complainant in this case filed a petition for $16,000 in attorney fees. This amount represents 40% of the $40,000 in compensatory damages awarded to the complainant in my Recommended Decision and Order of March 14, 1997, pursuant to his contingency fee contract with his attorney. No objections have been filed. After consideration of the nature of the issues involved and the skill with which the claimant was successfully represented, I conclude that the fees requested by the complainant's counsel were reasonably incurred and should be approved.
IT IS HEREBY ORDERED that the respondent, Western Kentucky University, shall pay $16,000.00 directly to Zachary M. Kafoglis, Esq., attorney for the complainant.
