                         FINAL ORDER OF DISMISSAL

     Before me for review is the Recommended Order for Dismissal
of Claim (R.O.) of the Administrative Law Judge (ALJ), dated
August 11, 1993, in this case arising under the employee
protection provision of the Energy Reorganization Act of 1974, as
amended (ERA), 42 U.S.C. § 5851 (1988).  The ALJ recommended
that the complaint be dismissed without prejudice based on
Complainant's failure to comply with his orders in this case.  
     Neither party has responded to my Order Establishing
Briefing Schedule issued on August 23, 1993.  Accordingly, I
adopt the ALJ's R.O. and the complaint is dismissed without
prejudice.
     SO ORDERED.
