ORDER TO SUBMIT STATUS REPORT

   On January 23, 1995, an Order Granting Motion to Stay was issued in this matter. The stay was granted pending resolution of a criminal proceeding relating to actions by the Complainant that may be relevant to the instant employee protection proceeding under the Energy Reorganization Act. The Respondent was directed to file status reports the first week of each month. The last status report was received on August 9, 1995. That report indicates that the criminal matter might be resolved in September 1995. On September 19, 1995, this Office received Respondent's Motion for Summary Judgment together with several supporting documents. There is no indication in these documents whether the criminal matter has been resolved. Complainant has not filed any documents in response to the Respondent's Motion for Summary Judgment. Accordingly,

   The parties are hereby ORDERED to file a report concerning the status of the criminal matter. The parties are also ORDERED to file a position statement on whether the stay can be lifted and this case assigned forthwith to an administrative law judge to conduct proceedings on the merits. To be timely, these reports, and position statements must be filed in time to be received by this Office no later than close of business (5:00 pm EST) on October 20, 1995.
