RECOMMENDED ORDER APPROVING SETTLEMENT
                           AND DISMISSING CASE


     This proceeding arises under Section 210 of the Energy
Reorganization Act, 42 U.S.C. S5851, and implementing regulations
at 29 C.F.R. Part 24.

     The parties have filed a joint motion seeking approval of a
Confidential Settlement Agreement and Release.  The Confidential
Settlement Agreement is incorporated by reference and attached
hereto.

     Respondent, Washington Public Power Supply System, submits
the Settlement Agreement pursuant to 29 C.F.R. §70.26(b) and
contends that the Settlement Agreement, including Appendix A, is
confidential commercial and financial information exempt from
disclosure under the Freedom of Information Act (11FOIA11). 
Respondent requests notice of any FOIA request seeking disclosure
of the Settlement Agreement, including Appendix A, prior to any
disclosure thereof.

     It appearing that the Settlement Agreement is fair, adequate
and reasonable, it is hereby recommended that the Secretary of
Labor approve the settlement and enter an order dismissing this
proceeding with prejudice.
