RECOMMENDED ORDER OF DISMISSAL

    This matter arises under the employee protection provision of the Energy Reorganization Act of 1974, 42 U.S.C. § 5851, and the regulations thereunder at 29 C.F.R. Part 24.

    On May 13, 1992, the undersigned issued an Order to Show Cause why this matter should not be dismissed as having been abandoned. Complainant was notified that failure to respond to the Order would result in the issuance of an order recommending dismissal as a result of abandonment. To date, Complainant has not responded to the Order. Accordingly, it is recommended that this matter be DISMISSED. See 29 C.F.R. § 24.5(e)(4)(i)(B), (ii) and 18.39(b); B.R. McCrumb v. Westinghouse Radiological Services, Case No. 89-ERA-42, Sec. Final order of Dismissal, April 9, 1992.
