ORDER APPROVING SETTLEMENT AND DISMISSING CASE

   Respondent, the United States Environmental Protection Agency, and the Complainant have submitted a Joint Motion to Dismiss the above-captioned case which arises under the employee protection provision of the Water Pollution Control Act, 33 U.S.C. § 1367 (1982). The joint request for dismissal is based on the fact that the parties have signed a Stipulation of Settlement, a copy of which is submitted with the motion.

   I have reviewed the Stipulation of Settlement. Without expressing any opinion as to substantive issues presented in this case, I conclude that the settlement terms are fair, adequate and reasonable in the circumstances. I therefore, approve the settlement. Accordingly, this matter IS DISMISSED.
