RECOMMENDED ORDER OF DISMISSAL

   This is a whistleblower complaint brought under the Comprehensive Environmental Response, Compensation, and Liability Act, 42 U.S.C. § 9610, the Federal Water Pollution Control Act, 33 U.S.C. §1367, the Safe Drinking Water, 42 U.S.C. § 300j-9, the Toxic Substances Control Act, 15 U.S.C. § 2622, and the Clean Air Act, 42 U.S.C. § 7622. A duly noticed hearing was scheduled in this case for March 23, 1999, in Long Beach, California. On March 18, 1999, the Complainant filed a Notice of Termination of Hearing, terminating the Appeal of the Fed-OSHA determination which requires dismissal of the complaint.

   Therefore, I find and conclude that the hearing should be cancelled and the complaint dismissed.

ORDER

It is Ordered that:

1. The hearing in this case set for March 23, 1999 is cancelled.

2. Case No. 99-WPC-004 is hereby dismissed.
