SETTLEMENT AGREEMENT This proceeding arises from a claim under the Water Pollution Control Act, 33 U.S.C. §1367, and the Clean Air Act, 42 U.S.C. §7622. Complainant and Respondent have filed a joint motion for approval of settlement agreement and dismissal of claim against Respondent and have submitted, for my review, a copy of all agreements settling any claims arising from the same factual circumstances forming the basis of the federal claim. Upon review and consideration of the provisions of all agreements by the parties, I find that the terms are a fair, adequate and reasonable settlement of Ms. Espinosa's claims against Respondent and should be approved. It is hereby RECOMMENDED that:
