DECISION AND ORDER GRANTING
RESPONDENT JOHNNY DUKE'S REQUEST FOR DISMISSAL

   This matter arose pursuant to §507(c) of the Federal Water Pollution Control Act, 33 U.S.C. 1367, and is presently set for hearing on October 10, 2001; however, by letter dated July 20, 2001, Complainant Johnny Duke specifically requests that he be dismissed from this action. A copy of said letter is marked Exhibit "A" and attached hereto.

ORDER

   In view of Mr. Duke's request, it is hereby ordered that Johnny Duke is dismissed as a party to this action. Robert Lake, however, shall remain a Complainant.

   SO ORDERED this 18th day of September, 2001, at Metairie, Louisiana.
