ORDER OF DISMISSAL

   Before the Board for review is the captioned matter arising under the Clean Air Act, 42 U.S.C. § 7622 (1988). Prior to a hearing, Complainant filed a Motion to dismiss this matter. Voluntary dismissals of ERA complaints are governed by Rule 41 of the Federal Rules of Civil Procedure. See Olsovsky v. Shell Western E & P, Inc., ARB No. 96-183, ALJ No. 96-CAA-1, ARB Dis. Ord., Oct. 23, 1996; Nolder v. Kaiser Engineers, Inc. Case No 84-ERA-5, Sec. Dec., June 28, 1985, slip op. at 6-8. Accordingly, the ALJ's recommendation is accepted and this case is DISMISSED WITHOUT PREJUDICE.
