ORDER APPROVING SETTLEMENT

    In response to my Order to Show Cause, sued June 1, 1990, Respondent's counsel advises that neither party wishes to have this case remanded to the ALJ for completion of the hearing. Respondent's counsel also advises that the Board of Directors of 50 West 67th Street, Inc., has ratified the settlement agreement, and that thus both counsel believe that my order of August 3, 1989, has been complied with. See Letter of June 11, 1990, from Sanford R. Oxfeld to Secretary Dole.

    In view of the above, I find that the contingency has been satisfied and that, therefore, the terms of he agreement are a fair, adequate and reasonable settlement of complainant's complaint under the Clean Air Act, 42 U.S.C. § 7622 (1982). I, therefore, adopt the recommendation of Administrative Law Judge Thomas W. Murrett that the settlement be approved. See Recommended Decision approving Settlement and Dismissing Complaint, March 13, 1989. Accordingly, the settlement is approved, and this case is DISMISSED.
