       Respondent.

DECISION AND ORDER OF DISMISSAL

By letter dated April 30, 1999, Leonard Limtiaco, Director, Occupational Safety and Health Administration, advised Complainant, Richard L. Neilson, that Complainant's allegation that he had been blacklisted by the Clark County Health District for engaging in protected activity under the Clean Air Act, 42 USC 7622 et seq., had not been substantiated. Mr. Neilson filed a timely appeal to the dismissal of his complaint.

This matter was scheduled for formal hearing in Las Vegas, Nevada, for October 14, 1999.

September 9, 1999 a document signed by Complainant entitled "Abandonment by Party" was received. Complainant stated that as "a result of insufficient resources and other circumstances beyond control of the Complainant, this notice of Abandonment is hereby served."

Accordingly, the trial of this matter is canceled and this matter is dismissed, with prejudice. It is so ORDERED.
