Rockefeller v. U.S. Department of Energy, 98-CAA-10 and 11

NOTICE OF APPEAL RIGHTS

   The Office of Administrative Law Judges is in receipt of a copy of Complainant's October 1, 1998, petition for review by the Administrative Review Board ("ARB") of the presiding administrative law judge's Recommended Decision and Order in Rockefeller v. U.S. Department of Energy, 98-CAA-10 and 11. Included in the petition is counsel for Complainant's ("Appellant") request that the ARB review the presiding administrative law judge's order in that matter barring Appellant from future appearances before the presiding judge. An appeal of an administrative law judge's order of disqualification under 29 C.F.R. § 18.36 lies with the Chief Administrative Law Judge of the Department of Labor. 29 C.F.R. § 18.36(b).

   Accordingly, any petition for review of the order of disqualification pursuant to Rule 18.36(b) must be submitted to the undersigned by the close of business (5:00 pm EST) on October 23, 1998.
