Washington, D.C. 20036

DATED: March 30, 1989

CASE NO. 88-CAA-6

In the Matter of

JOSEPH PAPA
    Claimant

    v.

CON EDISON
    Respondent

ORDER OF DISMISSAL

This proceeding arose under the Clean Air Act, 15 U.S.C. § 2601 et seq. A formal hearing scheduled for March 21, 1988, was postponed at the request of the Claimant. A subsequent hearing scheduled for May 25 and 27, 1988, was postponed so that the parties could finalize a settlement.

On March 21, 1989, the parties jointly filed a Settlement Agreement and General Release which effectively resolves the conflict.

Accordingly, good cause having been shown, the complaint in this matter is, hereby, dismissed with prejudice.

    It is so ORDERED.
