RECOMMENDED ORDER APPROVING SETTLEMENT

   On March 25, 2003, the parties submitted their executed settlement agreement in this case. They have requested that the terms of the settlement be kept confidential. Accordingly, the terms of the settlement will not be outlined here. Further, both parties are represented by counsel, and the settlement agreement is lengthy and detailed. Since I have not heard the case and have no basis to determine the merits of the respective parties' positions, I have no basis to second-guess the parties regarding the terms of the settlement.

   Accordingly, it is recommended that the settlement agreement be approved. Further, since the parties have designated the settlement agreement as "Confidential," it shall be subject to the pre-disclosure notification provisions contained in 29 C.F.R. §70.26 (2001).
